NXT CATCH AS is a product / service provider that offers sales and leasing of digital buoy systems that will contribute to a more economical and sustainable management of marine resources that benefit users and our society. According to privacy legislation, NXT CATCH AS is responsible for processing personal data.

NXT CATCH AS is a Norwegian company with registration no. 920 472 346, with business address; Torksevingen 17, 2819 Gjøvik, Norway and operates domains that are associated with websites such as nxtcatch.no, and nxtcatch.com as well as applications that are linked to these websites and SoMe platforms. This Privacy Policy applies to all our available digital platforms regardless of the medium is used when using the products/services.

Purpose of the Privacy Statement

This Privacy Policy is intended to help you understand what personal data we collect, why we collect it and how we store and delete your data. The Privacy Policy is an integral part of our terms of use, which you as a user of our product/service offer must accept when you register on our digital platforms. When you register as a user of NXTC's product/service solutions, we will ask for information that can identify you as a person, such as, for example, social security number, e-mail address, street address, telephone number, etc.

In the product/service solution, the administrator/user who has access to "My page" can register access to other people with defined graded access. Remember that you yourself are responsible for the processing of other people's personal data that you use or store by using the product/service.

Definitions and abbreviations we use in this Privacy Policy

NXT CATCH AS is referred to as NXTC, us, we, our, and ours.

By user, customer, client, administrator, viewer, and you, we mean all visitors to NXTCs who give us access to and leave contact information such as e.g., emails when subscribing to newsletters, creating a user profile, being a paying subscriber etc.

By "medium" we mean all digital devices that can be used to use our product / service solutions such as e.g., mobile, tablet, PC and their associated operating system.

"Cookies" are a small amount of data that is stored in the user's browser on the medium used when visiting our digital platforms. Read more about Cookies

We define "Digital Platform" as the places where you can connect and visit us digitally. Including websites, SoMe such as Instagram, Facebook etc. downloadable applications, connection via API etc.

 

What personal data does NXTC process?

We receive, collect and store any information you enter on our digital platforms or otherwise provide to us. This can be "non-personal information" and "personal data". Non-personal information consists of information that cannot be used to identify you personally. This can be platform types, URLs, and other anonymous user data.

Personal Data is information that NXTC can use to identify you as an individual. There will be basic contact information such as name, address, phone number, email, and demographic information. Users and web traffic such as login ID, username, and IP address. The company you work for, location data, access to the product/service solution. Payment information that you use. Content you have uploaded or shared on NXTC's digital platforms such as photos, comments, likes, articles and video clips. Statistics that show how users use our product/service solutions that we offer. We may use software tools to measure and collect session/sequence information, including page response times, how long certain pages are visited, page interaction information, and methods used to browse away from the site.

NXTC does not process sensitive personal data about you.

 

Why and how do we process personal data?

NXTC processes your personal data based on various purposes we want to achieve through your dialogue with us. The groupings are examples of the types of people we collect data about, why we collect and what we use collected data for.

When NXTC collects and processes personal data for purposes such as customer support, security, improvement of user experiences and when you provide a contact person for a potential or existing customer or supplier of goods and services. This is a legitimate interest that NXTC has in being able to fulfil concluded agreements and all personal data is processed for a business purpose that we believe will not conflict with your rights as a private individual.

Our legitimate interests also apply when we process your personal data that you give us access to when you sign up for webinars, courses, tickets to events or other content that you search for or download from our websites. Our legitimate interest is to be able to provide you with the correct content, at the right place and time, as well as manage your enquiries.

Purchase and delivery of product/service solutions with customers, suppliers and companies we work with.

Typically for this group, we will collect personal data and other relevant information about the contact persons in this type of company because we want to:

  • be able to develop business cooperation

  • Manage and fulfil contractual obligations such as customer orders, agreements and payments

  • Provide offers of products and services to customers

  • Create accounts and access for users of our product/service solutions

In addition, it may be necessary to perform certain actions before a contract can be concluded and it may also be necessary to collect data where NXTC must comply with a legal obligation bound by a concluded data processing agreement.

 

Visitors to our digital platforms

Visitors to our digital platforms such as websites, Facebook, Instagram etc. will in some cases give us personal data that can identify the person concerned. Identifying information will be sent to us by e.g.

  • sign up for newsletters,

  • comment and/or "like" posts;

  • send us an email,

  • sign up for webinars,

  • start a chat conversation

  • or other opportunities where you can provide personal data on our digital platforms. 

By providing us with personal data on our digital platforms, you agree that we can store and process this personal data. It is completely voluntary that you give us this information and you can unsubscribe from the newsletter at any time.

 

Support and improvements

For subscribers of NXTC's product/service solutions, we collect personal data about users provided by you or someone in your company, such as their name, email, user access rating, vessel registration number, home port location, buoy ID number, GPS - tracking of buoys that are in respective subscriptions. Buoy ID numbers and GPS tracking are "non-personal" data that is collected and stored but can be linked to the user in order to provide satisfactory customer support when needed. This link may be saved if the event indicates that this is necessary. In general, we use this information to communicate with you by:

  • Be able to offer customer support for our product / service solutions in a responsible manner with a good user experience.

  • Inform users about offers.

  • Improve and develop the quality of the total delivery which includes functionality, the user experience of our product / service solutions and on digital platforms. 

  • To create statistics and "non-personal" information that we and/or our business partners may use to provide and improve our product/service solutions.

 

Security

Your account is protected with your account password, and we encourage you to use a "strong password" with a minimum of 12 characters combined with UPPERCASE and lowercase letters, numbers and characters. Turn on two-step authentication. We encourage you to ensure that usernames and passwords are kept securely and not shared with others.  With clients that have multiple users in the form of administrators, users and Viewers share content such as historical data, active positions on buoys, etc. Access to personal data is controlled through grading the user's access by the administrator. Each person who wants access must create their own user account with a personal username and password.

The client pays for the subscription, but client, administrator and user can be one and the same person. We also take reasonable steps to ensure that other companies that provide payment services keep your information confidential and secure with encryption. However, this will not be under our control and by using our product/service solutions, you acknowledge that you understand and agree to expose yourself to such risks.

Recruitment

For job seekers who apply for a job at NXTC, personal data and other information that the applicant has chosen to share with us through the application will be stored for as long as the application process lasts. If you have submitted an "open" application or requested in writing that we keep the application for later calls, this is considered consent to us being able to store the information over a longer period. We use your personal data to:

  • Process job applications and manage recruitment processes

  • Review submitted documentation, contact candidates, interviews, and call references

You can withdraw your consent to store your personal data at any time.

How do we communicate with website visitors and subscribers to our product/service solutions?

We may contact you to notify you about your account, to notify you of incorrect use of the product/service solution that may be in violation of Norwegian law, to notify you of recovered buoys/gears, to troubleshoot problems with the product/service solution or the account your, to notify you of software and firmware updates, to resolve a dispute, to collect fees or money owed, to ask your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our user agreement, applicable national laws and any agreement we may have with you. For these purposes, we may contact you by email, telephone, text messages and post.

The vision of NXTC is to establish the company internationally with subsidiaries in several countries. To maintain visibility and insights, NXTC may share your Personal Data across NXTC companies in the future.

NXTC may also share your personal data with external third parties in the following contexts:

Our business is hosted on the Wix.com platform. Wix.com provide us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com's data storage, databases, and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company comply with the standards set by PCI-DSS managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

NXTC Digital Platforms
If you post, write comments on NXTC's social media or other forums on NXTC's websites, such information can be read and used by anyone who has access to such forums. NXTC is not responsible for any information you make available in such online forums, NXTC websites or other similar forums.

Business partners/subcontractors

NXTC may share your personal data with our partners as long as this is considered legitimate from a business perspective and is in accordance with applicable data protection legislation.

NXTC uses subcontractors who deliver cloud services and other IT services such as server hosting, development of hardware, software, firmware, customer support in case of software errors, hardware errors and maintenance thereof. Sharing your personal data is absolutely necessary to be able to offer the services you use from NXTC. This is to be able to provide correct customer support, provide you with content for the web platform such as positions, sensor data, timestamps for user sessions, capture data and historical data etc.

When using subcontractors, NXTC will enter into a Data Processing Agreement (DBA) to protect your rights to privacy under applicable data protection laws.

You are always welcome to request an overview and more detailed information about NXTC's subcontractors. How you can contact us is described in the last paragraph of this statement.

Public authorities
The police and other authorities may request the disclosure of personal data from NXTC. In such cases, NXTC will only disclose personal data and data if there is a court order or similar to do so.

 

How long do we keep your personal data and what are your rights?

NXTC only stores your personal data for as long as it is necessary to fulfil our obligations under agreements and contracts. Your personal data is stored as long as it is necessary to fulfil the purpose and there is a legal basis such as a legitimate interest or your consent so that we can safeguard your interests.  For this reason, your personal data may have different storage routines.

You have the right to access your personal data and may at any time request an overview of which personal data has been collected and processed about you and which subcontractors NXTC has at any time.  If you want to take your personal data from one business to another business, you may have the right to do so. If you suspect or discover errors in your personal data, you can contact us so we can correct this. You also have the right to delete or request limited access to, or object to, the processing of your personal data. In such cases, NXTC will have the right to not enter into an agreement or continue to provide our product/service solutions to you.  You are always welcome to contact us by sending to the email address privacy@nxtcatch.no  You also have the right to send a complaint to the Norwegian Data Protection Authority regarding our processing of your personal data.

Marketing and profiling

NXTC uses tools such as Google Analytics with technologies that collect cookies and are called profiling. The purpose of profiling is to improve the user experience when you visit our websites or other digital platforms.  This can give us better insight into what interests you as a potential or existing customer have, how you use websites, what you click on, the time you spend on each page, etc. The profiling also gives us the opportunity to combine this with information we have about your customer relationship privately or via your business and deliver relevant content to you through direct marketing on websites, SoMe channels, e-mail etc.
